Many newly Upgraded Offices Were Incorrectly Re-Classified as Non-Exempt
The NAPUS national office has received a flood of inquiries from Postmasters who were recently upgraded to levels 18 and re-classified to a non-exempt status. NAPUS has notified Postal Headquarters officials that it is our position that EAS 18 Postmasters who manage two or more full time equivalent employees (FTEs) should be classified as exempt.
NAPUS is concerned that the re-classification of many of the newly upgraded level 18 Postmasters appears to be in violation of FLSA requirements and Sections 444.321 and 434.12 of the ELM. NAPUS has requested an immediate clarification on this issue before it impacts leave usage, scheduling and overtime requirements for wrongfully classified Postmasters.
Headquarters officials have responded to NAPUS by saying that they are looking into the matter and will provide a clarification as soon as possible. An update will be posted on the NAPUS website as soon as information is received from USPS headquarters.
