3/12/2018 Beam Bros. Trucking Inc. (BBT), and its principals Gerald Beam and Garland Beam, have agreed to pay $1,025,000 to resolve allegations under the False Claims Act that BBT overcharged the U.S. Postal Service (USPS) on contracts to transport mail. BBT is a trucking company located in Mt. Crawford, Virginia.
“The Department of Justice takes seriously its role in protecting the federal procurement process from false claims,” said Acting Assistant Attorney General Chad A. Readler of the Justice Department’s Civil Division. “This settlement demonstrates that we will hold accountable federal contractors engaging in fraud, and will ensure that federal funds are protected from overcharges and abuse.”
“We are gratified to have contributed to this investigation and applaud the exceptional work by the investigative team for both protecting the contracting process and overall program costs,” said Special Agent in Charge Scott Pierce of the U.S. Postal Service Office of Inspector General. “Along with our law enforcement partners, the USPS OIG will continue to aggressively investigate those who engage in activities designed to defraud the Postal Service.”
“Contractors working for the federal government are held to the same high ethical standards as full-time employees,” U.S. Attorney for the District of New Jersey Craig Carpenito said. “This settlement will return more than $1 million to the USPS.”
USPS contracts with trucking companies, including BBT, to transport mail throughout the United States. On some contracts, USPS had provided trucking contractors with credit cards, known as Voyager Cards, to pay for fuel. This settlement resolves allegations that BBT misused Voyager Cards to purchase fuel on contracts that did not allow for their use, resulting in inflated charges in violation of the False Claims Act.
The settlement resolves allegations made in lawsuit filed under the whistleblower provision of the False Claims Act by Bobby Blizzard, a former BBT employee. The False Claims Act permits private parties to file suit on behalf of the United States for false claims and obtain a portion of the government’s recovery. Mr. Blizzard’s share of the recovery has yet to be determined.
The settlement was the result of a coordinated effort between the United States Attorney’s Office for the District of New Jersey, the Civil Division of the Department of Justice, and the USPS, Office of the Inspector General.
The lawsuit, which was filed in the District of New Jersey, is captioned United States ex rel. Doe v. Beam Bros. Trucking, Inc., Civil Action No. 10-657 (D.N.J.). The claims resolved by this settlement are allegations only, and there has been no determination of liability.
Former USPS Trucking Contractor sentenced for Conspiring to Violate Federal Highway Safety Regulations
Beam Bros. Trucking, Inc. (Beam Trucking) and Beam Bros. Holding Corporation (Beam Holding) were jointly sentenced by the court to forfeit to the government $2,000,000 of fraudulently obtained proceeds. They were also sentenced to pay approximately $1,000,000 in restitution to drivers who were defrauded of their pay. In addition, these companies were sentenced to serve 3 years of corporate probation and to pay a fine of $250,000 to the government.
Beam Holding previously pled guilty to conspiracy to commit wire fraud in that the company knowingly and willfully defrauded its driver employees of almost $1,000,000 dollars of their pay. In specific, Beam Holding caused their driver employees to falsify their time sheets so that they would report fewer hours worked than they actually worked in direct violation of the Fair Labor Standards Act and the McNamara-O’Hara Service Contract Act.
Beam Trucking previously pled guilty to conspiracy to falsify safety records and pay records in that the company falsely reported the hours their truck driver employees worked and were on duty with intent to obstruct the government’s investigation. In specific, Beam Trucking conspired to falsify drivers’ records of duty status and their time sheets

Hmmmm. A postal contractor that stole employees’ overtime and committed fraud when billing the USPS for their services? Well, that’s just to show that fraud and theft are not limited to USPS managers and work force employees.
It seems to me corporate America and our elected officials are totally incapable of acting with honesty, integrity, and decency. But the sad question is: would we as the “common” workers given the opportunity act the same way if we were elevated to high positions in various companies? Or would we remain steadfast in our integrity and refuse to participate in wrongdoing? Would we consider the possible actions that could be taken against us if we became whistleblowers?
People have died and otherwise been ruined for speaking out against criminal behavior. Business and financial America have seen to it that exposing criminal activity can be a very dangerous thing to do. So where does the honest man turn?
I wish I could say truthfully that labor employees would all be honest, capable and good stewards of corporations, but I can’t. I have known too many not in management in not just the USPS but other jobs where keeping certain people away from management was a very good idea. I believe good character and a sense of real responsibility are in short supply, and that the line between dishonest businesses and their CEO’s, management, etc., and the equally illegal shit the blue collar workers can and do commit is blurred to the point of near invisibility.
For those running this country and this world, they are extensions of ourselves in fortunate circumstances. Not every person in power is dishonest, mean, or a crook. And there are some politicians who are actually pretty decent people themselves. Our social behavior, mass mentality, and varying levels of gullibility for some and cynicism in others are noted by those who control us. Only when we perform in large enough numbers with exemplary behavior, intelligence and honesty can it possibly infiltrate the mind sets of the ruling classes.
