USPS employee alleges he was terminated while on FMLA leave

HOUSTON – A Houston man formerly employed by the United States Postal Service alleges he was retaliated against and terminated because he took a medical leave.

James Williams filed a complaint on Sept. 14 in the Houston Division of the Southern District of Texas against United States Postal Service alleging that the government agency violated the Family Medical Leave Act.

According to the complaint, the plaintiff alleges that during his employment with the defendant at its Aldine Bender, Houston location, his wife suffered from a serious health condition and he took FMLA leave to care for her. He alleges he was written up in April 2016 and was written up again when he had absences for doctor’s appointments and provided doctor’s excuses for them.

  2. This is typical. And while we’re on the subject of FMLA, do you know who to thank for the fact that we have it? Bill Clinton and the congressional Democrats. A version of FMLA was passed by Congress (which Democrats still controlled) in the early ’90s, which President Geroge H. W. Bush (R) vetoed. Congress (still Democratic) passed it again in I think ’93 or ’94, and Clinton signed it into law. So if it were up to the Republicans they could fire you for getting sick. And that’s regardless of how good an employee you are – the District and Area scum only look at the numbers, even if your local management likes you and you are a model employee.

    Indiana’s own Todd Rokita (R-4th) has at least proposed legislation that would make all Federal employment “at will,” which means that you could be fired for any reason whatsoever, as long as no specific laws were violated – in another words, if your boss just didn’t like you for some reason, or wanted to make a vacancy for a relative or lover, you could be fired with no recourse, as is often the case in the non-union private sector. So if this is what you want, keep voting for Republicans.

  3. postal management has always treated it’s employees like*hit! Always will because they get away with it. For management punishment is promotion, higher level pay. Management should be demoted to the grade of CCA. Then they could be treated the way they treated their “servants”. Time wounds all heels. It’s their turn to be miserable!

  4. This is why Fred Rolando needs to be voted out. Too many of these atrocities go on in the USPS. Vote for David Noble and the Clean Sweep!

  5. If it is true, he can sue the people who did it, there is no protection for harassing people on FMLA. Supervisors beware.

  6. what a compassionate company…….must have affected their PFP bonus scam money. how does all this crap happen with an Office of PO Inspector General? must be on the take too!
