USPS denies OWCP benefits to widow of Oakland postal worker who died after delayed 911 call

First widow Larnie Macasieb endured the sudden death of her husband after he sustained a major injury at a postal processing facility. Twice the federal Office of Workers’ Compensation denied her benefits requests.

An East Bay widow whose husband died after he sustained a serious injury at work is fighting for tens of thousands of dollars in benefits she believes the government owes her.

Twice Larnie Macasieb filed claims with the Department of Labor’s Office of Workers’ Compensation Programs after her husband Sam died. Twice the office denied her petitions, even though her husband suffered a major injury during his shift at an Oakland postal facility. Macasieb plans to file another appeal next year.

Macasieb’s attorneys say the United States Postal Service has the burden of proving her husband’s injuries were not work-related. But the government ruled, because no one saw what happened, there is no way to know how Macasieb’s husband sustained his injury.

That conflict is at the heart of this case. Macasieb says her husband was injured at work. The government says there is not enough evidence to prove what happened. Records show postal service personnel blocked law enforcement from the facility, rendering them unable to conduct an investigation

  1. If EMS came to treat him there should be a record of what they did and if they went to the Hospital ,and how long he stayed.

  2. Since, as stated, USPS mgmt. interfered with an active police investigation, why are they not being charged with such ?

  4. I really feel for this woman. These people at the labor dept are scum bags, they turn down every one and make claimants jump thru hoops. Almost every letter carrier in the U.S. has long term physical injuries from carrying the mail and when you seek compensation these maggots turn you down with “How can you say the job did this to you?”. I hope this gal gets every thing coming to her for her loss. I hope karma strikes these people at the dept of labor.

  5. what would you expect from modern America? If you are just a worker, you are just thought of as a cheap source of labor! You shouldn’t have any rights, nor do you need any! You are to work for free until you can’t work any more. And when you cash in, you never alive.
