03/28/2018 – The time is now for all current and former permanent-rehabilitation and limited-duty postal employees who were subjected to the USPS National Reassessment Process (NRP) between May 5, 2006 and July 1, 2011 to file a timely claim with the Postal Service to seek monetary damages and other relief.
The Postal Service has exhausted all of its administrative appeals in the class action discrimination complaint, McConnell v. USPS. The EEOC’s favorable decision, issued March 9, 2018, is final. The EEOC rejected the Postal Service’s request for reconsideration after finding the NRP discriminated against injured postal workers and violated their rights under the Rehabilitation Act. The Postal Service is now required to comply with a number of orders listed in the final decision.
More than 130,000 individuals, many belonging to the APWU, may benefit from this decision. Individuals were not required to file an EEOC complaint to be part of the class but members of the class are required to file a claim within 30 days of receiving notice from the Postal Service to avoid forfeiting any potential relief. Survivors of deceased class members are eligible and encouraged to apply within the designated time limits. Notifications from the Postal Service were said to be mailed to all eligible class members on March 19 and 20.
The law firm who litigated the legal claims before the EEOC informed the APWU that they also made a mailing to all class members on March 24 and 26 that reportedly provides instructions and offers guidance with claim filing. If you did not receive a notification and you believe you should be part of the class, you can still submit a claim. The law firm encourages claims to be filed no later than April 12, 2018. The APWU was advised that this is the first step in the claims process. They have a dedicated website, where we are told individuals can find filing instructions including where to send a claim, suggested claim forms, and more detailed information about the case, the decision and the claims process. We were further advised FAQ’s would be added to the site soon. The law firm has also indicated that it has launched a call center manned with paralegals to specifically offer assistance to claimants. Still have to wait 2 more years to get my retirement thrown out after 25 years of loyal service. I did my best my hips just not as good, pain. Sad thing is they didn’t seem to not care for the individual. I don’t expect anything they made my life a living hell, and the truth is I love our customers and serving them, God bless America. Some higher ups should pay, but they will probably get bonuses go figure.

After the Supervisor tried to fire me, 3 removal notices at once, she claimed I wasn’t on my assignment. Yet two Management and two Craft employees wrote letters that they were shuttled by me to the train station same time MGMT claimed I was off assignment. Then tried to justify the lie. Well a major stroke fell on her and I feel but can’t reach her.
Employees of the Postal Service are hard workers. Once injured you are constantly harassed, bullied and intimidated. This company is complicit.
I am glad Sandra McConnell et al won. Injured employees work restrictions are violated and they harass the work injury doctors too. The Postal Service is an extremely toxic place to work!
Yes, they won the class action NRP but rest assured the Postal Service will try their very best to get away with not paying claims!

These Criminals fired most of their injured employees! Some lost everything the worked for! The NRP was nation wide! They fired up the majority of permanently injured employees and thought they would get away with it.

If you believe that ,130,000 fakers, i have a bridge in Brooklyn i want to sell you.The so called FAKERS that are stealing taxpayer money are the management that go to the movies or getting haircuts,etc ,on the clock. They even have a postal service box at the ballpark. Postal workers are dedicated,hard working people that are given a bad rap ,put the flashlight on management where it belongs.
25 years, forced into retirement under threat of firing, 25 years and thrown out. It’s OK God provides, yes I was damaged and didn’t want to quit, hips and pain I still was doing it but not as fast. I feel so sorry that our brothers and sisters are treated so bad for, let’s face it, getting old.
I am one of those fakers and I will submit my fake claim, and take my real check to the bank.
If you will bother yourself to read the judge decision people like you are mention, that resulted in the fakers working in a hostile environment, thank you for your attitude.

I’m a retired postal employee with over 37 years of service.This abuse of injured workers was around when i was a sub clerk and had a broken wrist ,with my arm in a sling. They told me there was no light duty for me and had me lifting bags with one hand.A woman letter carrier injured her foot on the job and they had her standing up on a paper rack ,she quit her job .These people in postal management are sick sociopaths.God bless the postal unions who deal with these deranged people on a daikly basis. The year i retired there were 156,000 grievances and 26 ,000 EEO complaints against the postal service ;and they are still getting away with the abusive behavior,but not this time.
